Terms of Service

These Terms govern your use of FormitAI. They cover your account, the forms and data you create, payments you may collect through your forms, our AI features, billing, and the responsibilities you take on when collecting data from your respondents. Please read them carefully.

Agreement to these Terms

These Terms of Service (“Terms”) are a binding agreement between you and FormitAI (“FormitAI”, “we”, “us”, or “our”), operated from Lahore, Pakistan. They govern your access to and use of our AI-powered form building platform, including our website, applications, APIs, and related services (collectively, the “Services”).

By creating an account or using the Services, you accept these Terms and our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

If you do not agree to these Terms, do not use the Services.

The Services

FormitAI provides a platform that allows you to:

  • Create and edit forms, including with AI-assisted form generation;
  • Customize form design, logic, and validation rules;
  • Publish forms and collect submissions from respondents via direct links, website embeds, and other channels;
  • View analytics and insights about form performance;
  • Collaborate with team members through organizations and workspaces with role-based permissions;
  • Connect integrations, such as syncing responses to Google Sheets;
  • Optionally collect payments from respondents via payment fields powered by third-party payment processors (such as Stripe Connect).

We may improve, modify, or discontinue features of the Services over time. Where a change materially reduces core functionality you pay for, we will give you reasonable advance notice.

Payments collected through your forms

FormitAI may provide payment field types that let you (the form creator / merchant) accept payments from respondents. When you enable payments:

  • You are the merchant of record for those payments. Money is collected for you (or your connected payment account). FormitAI is a software platform and is not the seller of your goods or services.
  • You are solely responsible for the products, services, pricing, taxes, invoices, delivery, refunds, chargebacks, disputes, and customer support related to payments you receive.
  • Payment processing is provided by third parties (for example, Stripe). Their terms, fees, and policies apply between you, the processor, and the payer. FormitAI does not control settlement timing, bank payouts, or processor account approval.
  • FormitAI may charge a platform or application fee for enabling payment features. That fee does not make FormitAI a party to the sale between you and the respondent.
  • FormitAI is not responsible for failed, delayed, reversed, fraudulent, or disputed payments; for amounts you owe respondents or payment processors; or for any loss arising from your use of payment fields.
  • You must comply with applicable payment, consumer, tax, and anti-money-laundering laws in jurisdictions where you offer paid forms.

If you do not agree to these payment responsibilities, do not enable payment fields on your forms.

Accounts and registration

To use most features you must create an account. You agree to:

  • Provide accurate, current, and complete registration information and keep it up to date;
  • Keep your credentials confidential and not share your account;
  • Notify us promptly at hello@formitai.com of any unauthorized use of your account;
  • Take responsibility for all activity that occurs under your account.

You must be at least 16 years old to create an account. Accounts registered by bots or automated methods are not permitted.

Your content and form data

You own your content. You retain all rights to the forms you create, the prompts you provide to AI features, and the responses submitted through your forms (“Your Content”). We claim no ownership over it.

You grant us a limited, worldwide, non-exclusive license to host, store, process, display, and transmit Your Content solely as needed to provide and secure the Services.

You are the data controller of your respondents' data. If your forms collect personal data from respondents, you are responsible for having a lawful basis, informing respondents about your data practices, and handling their access/deletion requests.

AI features

The Services include AI-powered features, such as generating forms from natural language descriptions and suggesting follow-up questions, powered by third-party large language models.

  • Review outputs. AI-generated content may be inaccurate or unsuitable. You are responsible for reviewing before publishing.
  • No professional advice. AI outputs are not legal, medical, financial, or other professional advice.
  • Usage limits. AI features are subject to rate limits and fair use restrictions.
  • Similar outputs. Due to the nature of machine learning, outputs may be similar to those generated for other users.

Acceptable use

You agree not to use the Services to:

  • Violate any applicable law or regulation, or the rights of any third party;
  • Create forms for phishing, fraud, or deception;
  • Collect sensitive personal data without a lawful basis;
  • Send spam or unsolicited communications;
  • Upload or distribute malware;
  • Probe, scan, or test the vulnerability of our systems;
  • Access other users' data without authorization;
  • Resell or white-label the Services without written consent;
  • Reverse engineer the Services, except as permitted by law;
  • Use AI features to generate unlawful or harmful content.

Plans, billing, and trials

The Services are offered under free and paid subscription plans. For paid plans:

  • Fees are billed in advance on a recurring basis and are non-refundable except where required by law;
  • Subscriptions renew automatically unless cancelled before the renewal date;
  • We will give at least 30 days' notice before any price increase;
  • If payment fails, we may downgrade or suspend paid features after notice;
  • Taxes may be added where required by law.

Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Without limiting the above, FormitAI does not warrant or guarantee any payment outcome between you and your respondents, including successful authorization, capture, refund, or payout of funds collected through payment fields.

Limitation of liability

Our aggregate liability for all claims will not exceed the greater of (a) amounts you paid us in the 12 months before the event, or (b) USD 100. Nothing excludes liability that cannot be excluded under applicable law.

To the maximum extent permitted by law, FormitAI is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from (among other things) payments processed through your forms, disputes between you and respondents or payment processors, or your tax and compliance obligations as a merchant.

Governing law and disputes

These Terms are governed by the laws of Pakistan. Any dispute will be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan, unless mandatory consumer protection law provides otherwise.
